Terms of Use

By using our website or sending a loan request, you agree to these terms, which explain our role, your responsibilities and the limits on our liability.

01

Our Role and Who May Use the Site

We operate a free loan-request and matching service that sends your request to lenders and lending partners; we are not a lender or loan servicer, and we make no credit decisions.

Anyone researching upwise capital loan offers through this site should know that lenders alone decide approval, APR, fees, terms and funding time.

Eligibility to use the site

  • You must be at least 18 years old, or the age of majority in your state if that is higher.
  • You must be a resident of the United States and submit a request only for yourself.
  • You must be able to form a binding contract and must not be barred from using the service by law.
02

No Guarantee of Offers, Approval or Rates

Sending a request does not ensure that any lender will contact you, make an offer, approve a loan, or provide a particular APR, amount, term or funding time.

Accuracy of estimates

Rates, payments, totals and timelines on the site, including the representative example and the results of the personal loan calculator, are estimates for education only. They are not offers of credit. Your actual terms appear only in a lender's disclosure and loan agreement. Our explanation of how lenders price loans describes why real offers differ.

03

Your Responsibilities and Prohibited Use

You agree to give true, current and complete information, to use the service only for your own lawful loan request, and to read every lender disclosure before you accept an offer.

By sending a request, you also agree that we and the lenders that receive it may contact you by email, phone or text about your request, as described in our privacy policy. You can stop texts by replying STOP.

You may not

  • Submit false information or use another person's identity.
  • Use bots, scrapers or automated tools to access the site or collect its content or lender information.
  • Try to break, probe or bypass the site's security, or interfere with its operation.
  • Copy, resell or reverse engineer the site, the request form or our matching process.
  • Use the service for fraud, money laundering or any other unlawful purpose.
04

Third-Party Lender Terms

Any loan you accept is a contract between you and the lender, governed by the lender's own loan agreement, disclosures, privacy policy and terms, not by these terms.

  • Read the lender's full terms, including APR, fees, payment schedule and late-payment rules, before you sign.
  • Questions or disputes about a loan, payments or collections must be raised with the lender.
  • We do not control lenders and are not responsible for their decisions, products, statements or conduct.
  • Our advertiser and lending disclosure explains how lenders compensate us.

We grant you a limited, revocable, non-transferable right to view and use the site for your own personal, non-commercial purposes. You may share links to our pages, but you may not copy, republish or sell our content without written permission.

06

Disclaimers and Limitation of Liability

We provide the site and service as is and as available, without warranties of any kind, express or implied, to the fullest extent the law allows.

We do not warrant that the site will be uninterrupted, error-free or free of harmful code, or that any content is complete or current. Nothing on the site is legal, tax or financial advice.

To the fullest extent permitted by law, we and our team, partners and service providers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities, arising from your use of the site, a lender's decision or terms, or any loan you obtain. Some states do not allow certain limits on liability, so parts of this section may not apply to you.

Governing Law, Changes and Contact

South Dakota law governs these terms, without regard to its conflict-of-law rules, except where federal law or the law of your state requires otherwise.

We may update these terms at any time. When we do, we post the new version on this page with a revised effective date, and your continued use of the site after that means you accept the changes.

Questions about these terms can go to [email protected], (888) 821-8471, or 162 Hillcrest Lane, Suite 229, Pierre, SD 57501. Hours and support details are on our contact page.
